Dangerous Drugs and Defective Devices Lawyers

Strict Liability claims allow attorneys and injured parties to proceed without having to prove a particular act on the part of the seller or manufacturer, although it still must be proven that the product was defective.  Instead, your lawyer must prove that the product was defective at the time it left the control of the seller. The general elements of a strict liability products case include: 

  1. The product was in defective condition at the time it left the possession of the seller or manufacturer; 
  1. The product was unreasonably dangerous; and 
  1. The product caused injuries.  

Breach of warranty cases typically involve a failure to properly want consumers of various known risks.  And, last but not least, harmful products cases relying on ordinary negligence are involve a failure to do what an ordinary, reasonable manufacturer should have done.
