Here is some helpful information, as well as answers to our most frequently asked questions.

A wrongful death occurs when a person is killed due to the fault of another party. Examples are deaths caused by car accidents, medical errors or defective products. Illinois has created laws to allow the estate and victim’s survivors to recover compensation. Those laws include:

  • Illinois Wrongful Death Act – Allows survivors to sue for their own pecuniary, or monetary, losses. The survivors typically are the victim’s spouse, children and parents.
  • Illinois Survival Act – Allows the victim’s estate to recover for economic and non-economic harm the victim suffered between the time of injury and time of death.

A claim in Illinois is separate and distinct from a survival lawsuit. However, in most cases, both claims are pursued at the same time against the same parties.

In a medical malpractice wrongful death matter, the victim’s spouse and next of kin may recover money. The eligible family members are listed in the Illinois Wrongful Death Act and include children, parents and siblings.

Wrongful death cases can resolve in a few months or sometimes take several years to fix. Here are some of the things that influence how long a case takes.

  • Amount of Insurance – Sometimes, the responsibility for the accident is clear but the “at fault” party has minimal insurance. In most cases, the other insurance will pay minimal limits upon demand. On the other hand, there may be a case where there are minimal limits for the “at fault” party, but larger uninsured or underinsured motorist limits. In those cases, the settlement for the “at fault” party typically happens very quickly (in a month or two) and there will later be an uninsured motorist claim which will take longer to resolve. In a case where there is a large insurance policy ($250,000 or more) for the “at fault” Driver, the insurance typically does not offer to pay the policy limits until discovery isUnderway, that is until at least key depositions are taken.
  • Liability – Where responsibility of wrongful death is contested, litigation will usually be necessary. In these cases, it can take months or even a year or two before the case is ready for trial.
  • Ridiculous Valuation of the Death – It’s sad but true that insurance companies and adjusters are often callous and offer nowhere near a fair case value when dealing with a wrongful death case. When this occurs in our office, we immediately file suit and move the matter towards trial. It does not pay to negotiate when an insurer is acting in bad faith and simply to delay paying a valid claim.

Wrongful death lawsuits can be complex, and there are many legal requirements and time limits that apply. Anyone who has lost a loved one as the result of another’s negligence should consult with an experienced wrongful death attorney as soon as possible.

In a wrongful death accident case, the surviving family member files a lawsuit against the person or entity whose negligence, wrongdoing or default caused the death. Depending on the cause of the death, the responsible party could include:

  • Another driver
  • Employer
  • Co-worker
  • Doctor, nurse, anesthesiologist, hospital or other health care provider
  • Owner of a dog who killed a person.

Our services are offered on a “contingency fee” basis, which means that our fees for representing you will be deducted from the final personal injury settlement in your case—or from the damages awarded after a favorable verdict, in the event that your case makes it all the way to court trial. If you aren’t awarded a favorable outcome, then the firm would not collect a fee. 

Most medical negligence cases in Illinois, including hospital negligence cases, must be brought within two years of the victim’s death. But, a family should not wait until this two-year deadline approaches before contacting a lawyer. Lawyers need time to investigate complicated medical malpractice cases.
