Fish – Case Study

Adam J. Zayed and Julian D. Hoshell secured a $2,500,000 settlement on behalf of a woman rear-ended by a commercial tow truck driver who was utilizing his cell phone while speeding and with marijuana and cocaine in his system. Our client suffered injuries to her cervical spine including fusion surgery.

Rockford, Illinois – Zayed Law Offices Personal Injury Attorneys secured a $2,500,000 settlement with representatives of A to Z Towing for injuries sustained by a client injured in a rear-end crash.

On October 29, 2021, the client, who has elected to remain anonymous, was stopped behind numerous vehicles on Forest Hills Road in Rockford Township when the A to Z Towing truck approached quickly from behind and struck her vehicle at a significant speed. The client sustained injuries to her neck resulting in fusion surgery.

The client hired Zayed Law Offices just days after the collision, and at that point, the team immediately began important investigative work by preserving evidence. Immediately after the crash, the A to Z Towing driver offered multiple versions of the events precipitating the crash, including that he was unable to stop in time due to wet conditions and that our client abruptly stopped in front of him such that he stepped on his brake and the wheels locked up.

After filing suit, we learned that these statements were contrary to the events captured by the dashcam footage from the A to Z Towing truck. The footage showed the A to Z Towing driver looking down at his phone leading up to the crash. While the A to Z Towing driver contended that he stepped on his brakes and the wheels locked up, the dashcam footage actually showed him accelerating to a speed in excess of the posted speed limit immediately prior to the collision.

Throughout the course of the litigation, our office fought to obtain additional key evidence in the case, including but not limited to post-collision drug test results, medical certificates required by federal regulations, employment files, and cell phone records, to name a few.  Our office also discovered other key evidence that suggested A to Z Towing negligently hired the at-fault driver and that A to Z Towing allowed and actively encouraged the at-fault driver to use a cell phone while driving its commercial motor vehicles.

A to Z Towing denied liability throughout litigation and indicated that they were of the opinion that the at fault driver was operating his vehicle in a safe manner on the day of the crash.  The at fault driver himself conceded that he knew it was not safe to text while driving, but he intentionally and voluntarily chose to do so anyways.

“This is a tremendous award for our client and one of the highest in Winnebago County history. We enjoy fighting for our clients in Winnebago County. This was a special award for a deserving client,” said Mr. Zayed.
