Failure to Diagnose – Case Study

$800,000 – confidential settlement against a medical group and physician  

Will County, Illinois – In what is thought to be a record, Adam J. Zayed secures $800,000 medical malpractice wrongful death settlement on behalf of two adult children. 

Our clients’ mother was a 61-year-old female. After presenting to the defendant medical group, a routine lab and lipid panel was ordered. The results of the lab and lipid panel were wildly abnormal. The physician failed to act upon the abnormal results, including ordering appropriate medical imaging and instead diagnosed her with chest pain and anxiety.

Our clients’ mother saw the medical group and/or physician several more times and in each instance, the abnormal findings were not mentioned nor acted upon. Again, chest pain was noted. On one of her final visits with the medical group and physician, her blood pressure was elevated and she indicated to the physician she was worried that she would have a stroke or heart attack. The defendant physician did not take immediate action or send her to a hospital for a complete cardiac and pulmonary workup.

Unfortunately, our clients’ mother suffered a heart attack just one day after her statement to the physician expressing her concerns about the same. She passed away the following day. For nearly a year, our clients’ mothers’ heart disease was undiagnosed and untreated leading to her untimely death.
